HERON LAKE CITY COUNCIL
TUESDAY, JULY 9, 2019, 7:00 PM
REGULAR MEETING

The meeting was called to order at 7:00 PM by Mayor Jason Freking, with the following council members present; Glenn Kuhnau, Andrew Rasche, Danni Swanson and Carol Wagner. Others in attendance were Jerry Christopherson, Jim Eigenberg, Jackson County Sherriff Haken, Joe Liepold, Police Chief Anthony Fauglid, John Haberman, and Stacy J. Grube.

Approval of Agenda
Council Member Kuhnau moved, seconded by Council Member Rasche, to approve the agenda with the additions of Raffle Permit for North Heron Lake Game Producers, and an update from Southwest Broadband. Vote on the motion: Freking, Kuhnau, Rasche, Swanson and Wagner, aye; no nays. Motion carried.

Approval of Minutes
Council Member Rasche moved, seconded by Council Member Wagner, to approve the minutes of the Council Meeting of June 5, 2019, as presented. Vote on the motion: Freking, Kuhnau, Rasche, Swanson and Wagner, aye; no nays. Motion carried.

Accept Donations
Council Member Rasche moved, seconded by Council Member Kuhnau to approve Resolution 2019 – 7, accepting the following donations: 1) $250.00 from Security State Bank to Heron Lake Fire Department; 2) $100.00 from Ruth Doherty to Heron Lake Fire Department; 3) $750.00 from Heron Lake Young Men’s Club to the Heron Lake Summer Recreation Program. Vote on the motion, Freking, Kuhnau, Rasche, Swanson and Wagner, aye; no nays. Motion carried.

Zoning Permit
Council was presented with a Zoning Permit from Security State Bank to place a flag pole on the bank property. Council tabled the current zoning permit and directed staff to request a progress update on demo process.

Jackson County Assessments – Forfeited Properties
Council was presented with information on five forfeited properties that Jackson County is planning to auction. Jackson County is willing to pay expenses since forfeiture in the amount of $3,820.02. Jackson County Auditor/Treasurer’s office questioned if the City of Heron Lake is willing to forgive the following expenses that were incurred by the City prior to forfeiture: 1) Parcel 22.200.0580, 802 2nd Avenue for $1,275.00; 2) Parcel 22.200.1320, 141 9th Street NW for $600.00; Parcel 22.200.2100, 532 11th Street for $2,300.00; 4) Parcel 22.200.2110, 512 11th Street for $1,069.92, totaling $5,244.92. Discussion resulted in:
Council Member Kuhnau moved, seconded by Council Member Wagner to forgive expenses incurred prior to forfeiture, contingent on Jackson County forgiving their own expenses incurred. Vote on the motion: Freking, Kuhnau, Rasche, Swanson and Wagner, aye; no nays. Motion carried.

Ordinance – Sample Ordinance for wells
Council was presented with a sample ordinance prohibiting wells within City limits from the City Attorney. Discussion resulted in directing staff to contact City Attorney with an addition regarding existing wells.

PeopleService
Joe Liepold reported the following: 1) Valve turning will begin soon; 2) Water hydrant was replaced at the City Park; 3) Jeff Dale from Rural Water will be coming to help fix fire hydrants; 4) One discharge at pond completed; 5) Reviewed proposal to complete work on Industrial South Well, Council directed PeopleService to obtain additional bid.

Public Works
John Haberman reported the following: 1) Trimble battery issues continue, staff was directed to purchase a battery; 2) Tree at Falcon Heights has been removed; 3) Storm water updates included 16th Street is working and Chapman is now complete; 4) Erosion at stabilization ponds will be monitored; 5) Street work projects estimates were reviewed, staff will obtain more specific estimates; 6) Discussion regarding placement of fire extinguishers at Falcon Heights were discussed.

Police Department
Chief Fauglid reported 175 calls in June, which included directed patrols on Highway 60 and the City Park. Chief Fauglid and Jackson County Sherriff Haken presented an agreement to Council to as an option to provide additional on-call services if needed, Council took under advisement.

Fire Department
Council Member Rasche reported that the Fire Department is applying for a grant to help purchase turnout gear and equipment.

North Heron Lake Game Producers
Council Member Rasche moved, seconded by Council Member Wagner to approve the lawful gambling application for NHLGP to conduct a raffle at their fundraiser to be held at the Heron Lake Community Center on September 21, 2019. Vote on the motion: Freking, Kuhnau, Rasche, Swanson and Wagner, aye; no nays. Motion carried.

Other Business – No action taken
Council Member Kuhnau shared that Southwest Minnesota Broadband is no longer intending to pay their loans in full at this time.
MnDOT sent a written update regarding changes to RCUTs.
Council was informed that training is now available for LBA&E certification.

Claims
Council Member Kuhnau moved, seconded by Council Member Rasche, to approve payment of claims as presented, totaling $260,689.16. Vote on the motion: Freking, Kuhnau, Rasche, Swanson and Wagner, aye; no nays. Motion carried.

Mayor Freking moved, seconded by Council Member Rasche, to adjourn at 8:40 PM. Vote on the motion: Freking, Kuhnau, Rasche, Swanson and Wagner, aye; no nays. Motion carried.
