The meeting was called to order by Mayor Rasche.

Council Member Kuhnau wanted to inform the council of the Southwest Broadband meeting that he attended. Will be added to the agenda under other business. Motion made by Council Member Baumann to approve agenda with the addition of Southwest Broadband discussion. Seconded by Council Member Schumacher. OLD BUSINESS
Cellphone Tower
Application filled out by Fest Transportation for a cellphone tower placed on that property.

Everything is done up to attaching the card readers.
Website Information
Discussion with staying with what we currently have and talking to the current website manager to get the access and passwords to take it over in the city office.
Earned Sick & Safe Time
The clerk is still working on this. Will be attending another Employment Law Seminar to get everything finalized by next meeting. QuickBooks does not have a separate line for being able to track the hours accrued or hours used. QuickBooks says that they are working on an update for this.
MN Peip – Rates for 2024 – Henderson Financial.
Discussion on that we already have passed a motion on staying with MN Peip.
102 16th Street – Birkholz
Discussion on emails that were receive from City Attorney Birkholz. The council agreed to continue with prosecution as reviewed in the emails.
NEW BUSINESS
Zoning Permit – 301 8th Street
Reviewed Zoning Board meeting minutes and their recommendation for the variance. Motion made by Council Member Schumacher to approve the zoning permit with variance. Seconded by Council Member Haberman. Vote on the motion Rasche, Kuhnau, Schumacher, Haberman, Bauman – aye. No Nays. Motion passed.
Falcon Heights AC/Furnace
Public Works Haberman presented two bids for replacement of the furnace in one of the apartments. Motion made by Mayor Rasche to approve the bid from Schwalbach for $7600.00 to replace the AC and Furnace. Seconded by Council Member Schumacher. Vote on the motion Rasche, Kuhnau, Schumacher, Haberman, Bauman – aye. No Nays. Motion passed.
Community Center Roof
Public Works Haberman made the council aware of the leaks all over the roof that were found during that last storm. Determined that poor workmanship with the building of the center and when the roof was replaced when it collapsed. Received three estimates for roof replacement and repairs. The discussion was on putting shingles vs. stone coated steel. Motion made by Mayor Rasche to accept the estimate from Dan Wagner Construction with the stone coated steel shingles for $151,600. Seconded by Council Member Kuhnau. Vote on the motion Rasche, Kuhnau, Schumacher, Haberman, Bauman – aye. No Nays. Motion passed.
Resolution 2023-17
The Heron Lake Fire Department received $24,000 from New Vision. Motion made by Council Member Baumann to accept donation. Seconded by Council Member Kuhnau. Vote on the motion Rasche, Kuhnau, Schumacher, Haberman, Bauman – aye. No Nays. Motion passed.
Resolution 2023-18
Resolution Adopting Assessment for Unpaid Bills
Discussion on what is included to be sent to the County Assessor to be assessed to the property of the unpaid bills. Motion made by Council Member Schumacher to approve this resolution. Seconded by Council Member Haberman. Vote on the motion Rasche, Kuhnau, Schumacher, Haberman, Bauman – aye. No Nays. Motion passed.

Motion made Mayor Rasche to approve resolution for the variance application of 301 8th Street. Seconded by Council Member Kuhnau. Vote on the motion Rasche, Kuhnau, Schumacher, Haberman, Bauman – aye. No Nays. Motion passed.
LIQUOR STORE – MONTHLY REPORT – BRIDGIT PRESTON, MANAGER
Discussion on the paneling around the bar. Questioning what is behind the paneling and what will be needed to attach it properly. Council tabled until further information can be received.
AMBULANCE – MONTHLY REPORT – JOE LIEPOLD DIRECTOR
No report. Director not able to attend meeting.
FIRE DEPARTMENT – MONTHLY REPORT- CHAD DIEMER, FIRE CHIEF
No report. Fire Chief unable to attend meeting.
PEOPLESERVICE – MONTHLY REPORT – JOE LIEPOLD, OPERATOR
No report. Operator unable to attend meeting.
PUBLIC WORKS – MONTHLY REPORT – JOHN HABERMAN, PUBLIC WORKS
Discussion on the tree trimming that was completed with no issues. All went well and was reasonable with AJ’s Tree Service.
Jackson County has installed a catch basin on the corner of Second Street and Co. Rd 49. Pouring the concrete yet this week.
POLICE DEPARTMENT – MONTHLY REPORT – TONY FAUGLID, POLICE CHIEF
The Heron Lake Police Report was reviewed by the council. Halloween went good with no issues. 100 or so kids attended the trunk or treat on 3rd Ave. Per State of MN all police cars are to have Narcan doses in their possession for drug overdoses. Chief Fauglid has received 24 doses. Has completed his firearms training.
Ordinance 180 Revision – Went through the second reading of Ordinance 264 to repeal Ordinance 180 regarding the Compost and Burning Site Location. A public hearing will be held before next month’s meeting.

Southwest Broadband update: They have put in 61 new drops. They have a new device called SmartTown that they can put in the park for help with the Wi-Fi issues in the park area.
