HERON LAKE CITY COUNCIL
ASSESSMENT HEARING
WEDNESDAY, NOVEMBER 7, 2018, 7:00 PM

            The hearing was opened by Mayor Jason Freking, with the following council members present; Roger FitzHenry, Glenn Kuhnau, Andrew Rasche, and Carol Wagner.  There were no comments concerning the assessment list.

            Any payments received before the next council meeting will be removed from the assessment list and the council will approve a resolution at the December meeting to certify the reaming amounts for the county auditor.

            Mayor Freking closed the hearing.

REGULAR MEETING
WEDNESDAY, NOVEMBER 7, 2018, 7:00 PM

The meeting was called to order at 7:00 PM by Mayor Jason Freking, with the following council members present: Roger FitzHenry, Glenn Kuhnau, Andrew Rasche and Carol Wagner.

Also present were: Greg Ous and Peter Harff from MnDOT, Butch Mathias, Carol Schreiber, Mike Fest, Terri Stenzel, Dan Jensen, Ryan Fauglid, Jerry Christopherson, Cammy Winkler, Robert Ferguson, Paul Henning, Diana Madsen, Phyllis Nitch, Myron Horkey, Jim Eigenberg, Burt & Pat Bonnell, Wayne Rasche, Jackie Liepold, Rachel Daberkow, Chad Diemer, Joe Liepold, Police Chief Tony Fauglid, John Haberman, Tamara Shelton and Stacy Grube.

Agenda

            Council Member Wagner moved, seconded by Council Member Kuhnau, to approve the agenda with the additions of accepting a grant on behalf of the fire department, rescheduling date of budget meeting and setting a date to canvass election results.  Vote on the motion: FitzHenry, Freking, Kuhnau, Rasche, and Wagner, aye; no nays.  Motion carried. 

Minutes

            Council Member Kuhnau moved, seconded by Council Member Rasche, to approve the minutes of the October 3, 2018 council meeting as presented.  Vote on the motion: FitzHenry, Freking, Kuhnau, Rasche, and Wagner, aye; no nays.  Motion carried. 

Reduced Conflict Intersection Project – Greg Ous, Peter Harrf

            Greg Ous read and presented to Council a letter of response to action taken by City Council to rescind support for construction of RCI’s at the intersections of Highway 60 with CSAH’s 24, 9, and 43.  MnDOT has made the decision is to move forward with the construction of the RCI’s as planned during the summer of 2019.  After lengthy discussion and input from community members, Council Member Rasche requested that they compromise by excluding the RCI at the Highway 60 and CSAH24.  Greg Ous and Peter Harff stated that discussion will be held on this option and their final decision will be returned to Council by the end of the month. 

Zoning Permit & Variance, 106 18th Street

            Council Member Kuhnau moved, seconded by Council Member Wagner, to approve Resolution 2018-14, approving the zoning permit and variance of Michael Mooney to build a Pole Barn for storage at 10618th Street.  Vote on the motion: FitzHenry, Freking, Kuhnau, Rasche, and Wagner, aye; no nays.  Motion carried.   

Zoning Permit

            Council Member FitzHenry moved ,seconded by Council Member Rasche, to approve the zoning permit of Ed and Colleen Freking to build a deck and ramp at 511 12th Street.  Vote on the motion: FitzHenry, Kuhnau, Rasche and Wagner, aye; no nays; Freking, abstained. Motion carried. 

Parcel R 22.561.0140 – 108 18th Street

            Discussion was held regarding City owned property at 108 18th Street.   Michael Mooney has expressed interest in purchasing the City owned lot as he is building at 106 18thStreet. 

            Council Member FitzHenry moved, seconded by Council Member Kuhnau to sell Parcel 22.561.0140 – 108 18th Street to Michael Mooney for $200 plus all closing costs.  Vote on the motion: FitzHenry, Freking, Kuhnau, Rasche, and Wagner, aye; no nays. Motion carried. 

Tax Forfeited Property

Council Member Rasche moved, seconded by Council Member Kuhnau to approveResolution 2018-15, to Approve Tax Forfeited Property, 532 11thStreet (Parcel #22.200.2100) for Auction. Vote on the motion: FitzHenry, Freking, Kuhnau, Rasche, and Wagner, aye; no nays. Motion carried.

 Business Cigarette and 3.2 Licenses Renewals

Council Member FitzHenry moved, seconded by Council Member Kuhnau, to approve the cigarette and tobacco product sales licenses to P&J’s Mini Mart and Expressway and 3.2 liquor sales license to Expressway, all three for 2019.  Vote on the motion: FitzHenry, Freking, Kuhnau, Rasche, and Wagner, aye; no nays.  Motion carried.   

Employee Health Insurance

            Council Member Rasche moved, seconded by Council Member Kuhnau to accept quote from the Public Employees Insurance Pool, Advantage Health Plan for 2019 for eligible employees.  Vote on the motion: FitzHenry, Freking, Kuhnau, Rasche, and Wagner, aye; no nays.  Motion carried. 

Library

            Council Member Rasche moved, seconded by Council Member Kuhnau to accept the resignation of Bethany Vazquez from the Heron Lake Library Board. Vote on the motion: FitzHenry, Freking, Kuhnau, Rasche, and Wagner, aye; no nays. Motion carried

Falcon Heights

            Council Member Wagner moved, seconded by Mayor Freking, to approve the Quote from Schwalbach’s to replace a burner assembly, at Schwalbach’s recommendation, for $170.00.  Vote on the motion: FitzHenry, Freking, Kuhnau, Rasche, and Wagner, aye; no nays. Motion carried. 

Southwest Minnesota Initiative Foundation

            Council Member Kuhnau moved, seconded by Council Member FitzHenry to approve a $500 donationto SWIF, as the foundation invests in our community. PeopleService

            Joe Liepold reported the following; 1) Reviewed issues with Industrial Wells;  2) Flushing was completed in October and went well;  3) Chapman pumps have been pulled and blockages have been cleaned, Asphalt has been repaired;  4)  Omni Site equipment monitoring lift stations will need updating of cellular technology to5G, PeopleService is looking into options for the needed updates.  

Public Works

John Haberman reported the following; 1) Elite Mechanical will change valve at the Library, but are requesting in writing that the City will disconnect the sprinklers;   2) Storm ditch is cleaned although the dirt has not been spread out yet; 3) Mill & paving along 5th Ave Curb between 11th & 12th Street; 4) Claims from Neinkerk were reviewed with Council, discussion resulted in:

            Council Member Rasche moved, seconded by Council Member Wagner, to approve payment of $1,611.50 for extra sewer pipe and digging, and denied claim for $1,410.00 for expenses pertaining to the gas line issue.  Vote on the motion: FitzHenry, Freking, Kuhnau, Rasche, and Wagner, aye; no nays.  Motion carried. 

Police Department

            Chief Fauglid presented his monthly reports to the Council. There were 85 calls in October.  Chief Fauglid also reported that charges have been filed for the burglary at Laundromat.    

Fire Department

            Council Member Kuhnau moved, seconded by Council Member Wagner, to approve Resolution 2018 – 16, accepting a Grant award in the amount of $3,000.00 from Compeer Financial to the Heron Lake Fire Department.  Vote on the motion: FitzHenry, Freking, Kuhnau, Rasche, and Wagner, aye; no nays.  Motion carried.

Other Business

             Budget Workshop has beenrescheduled for December 4, 2018. Canvassing of Election results will be held on November 13, 2018 at 8:00am.  Council was updated that MVTV will not be placing additional equipment on the water tower.  Council received copy of the notification of compliance with Pay Equity.

Claims

            Council Member Rasche moved, seconded by Council Member Wagner, to approve claims as presented totaling $243,612.88.  Vote on the motion: FitzHenry, Freking, Kuhnau, Rasche, and Wagner, aye; no nays. Motion carried.
