HERON LAKE CITY COUNCIL
REGULAR MEETING
WEDNESDAY, August 1, 2018, 7:00 PM

The meeting was called to order at 7:00 PM by Mayor Jason Freking, with the following council members present: Roger FitzHenry, Glenn Kuhnau, Andrew Rasche and Carol Wagner.
Also present were: Michael Novitzki from KLM Engineering, Jim Eigenberg, Danni Swanson, Jerry Wagner, Joe Liepold, Fire Chief Chad Diemer, Police Chief Tony Fauglid, John Haberman, Tamara Shelton and Stacy Grube.

Agenda
Mayor Freking moved, seconded by Council Member Rasche, to approve the agenda, with the addition of Commissioner Eigenberg speaking regarding an upcoming detour, and Council Member FitzHenry giving an update on the Industrial Water /Wells. Vote on the motion: FitzHenry, Freking, Kuhnau, Rasche, and Wagner, aye; no nays. Motion carried.

Minutes
Mayor Freking moved, seconded by Council Member FitzHenry, to approve the minutes of the July 11, 2018 council meeting, with the correction of votes on Tree Trimming to reflect that Council Member Kuhnau voted nay. Vote on the motion: FitzHenry, Freking, Kuhnau, Rasche, and Wagner, aye; no nays. Motion carried.

Detour on Highway 60
Commissioner Jim Eigenberg reported that Highway 60 south from Windom will be detoured to Highway 62 west out of Windom to County Road 9 when work begins on the bump in Wilder. Estimated time of repair on Highway 60 is 30-60 days. Police Chief will put notice in the local newspaper and on social media.

Water Tower Contracts
Michael Novitzki from KLM Engineering presented information to Council regarding services KLM could provide for Heron Lake’s water tower. Services include cleaning, disinfecting, checking rafters, images of inside the tower, written reports, and adhering to rules and regulations of MDH.
Proposed contract from McGuire Iron, Inc. was also reviewed. Council requested Joe Liepold from PeopleService to speak with both firms to ask them to drop one cleaning and readjust their prices.

Zoning Permit
Council Member Rasche moved, seconded by Council Member Kuhnau, to approve the zoning permit of Daniel Koopman to build a pole building at 131 Strawberry Lane (changed to 90’ from center of road instead of 60’ from center of road previously listed). Vote on the motion: FitzHenry, Freking, Kuhnau, Rasche, and Wagner, aye; no nays. Motion carried.

North Heron Lake Game Producers
Council Member Kuhnau moved, seconded by Mayor Freking, to approve the lawful gambling application for NHLGP to conduct a raffle at their fundraiser to be held at the Heron Lake Community Center on September 22, 2018. Vote on the motion: FitzHenry, Freking, Kuhnau, Rasche, and Wagner, aye; no nays. Motion carried.

PeopleService
Discussion was held on the proposed pricing provided by PeopleService, including clarification on cost and time length. Discussion resulted in:
Council Member FitzHenry moved, seconded by Council Member Wagner to approve renewing the contract for a five year term with PeopleService for $6,000 per month. Vote on the motion: FitzHenry, Freking, Rasche, and Wagner, aye; Kuhnau, nay. Motion carried.

Tree Trimming
Council instructed Public Works to do a review of the current tree trimming throughout town and to compile a list of anyone needing a follow-up letter. Discussion regarding city trees that Public Works is unable to trim on his own resulted in.
Mayor Freking moved, seconded by Council Member Rasche, to approve Public Works obtaining bids and going with best bid to have city trees trimmed to be in compliance. Vote on the motion: FitzHenry, Freking, Kuhnau, Rasche, and Wagner, aye; no nays. Motion carried.

Valve/Curb Stop at Elementary
PeopleService reported that there is no valve after the Assisted Living Home to be able to shut the school off individually. In order to complete any work at the school, the Assisted Living Home would also need to be shut off. Council directed Joe Liepold to present information to the School.

PeopleService
Joe Liepold reported the following; 1) Meter is in at HLBE; 2) Two hydrants have had parts replaced; 3) Library valve parts are in, will work with Public Works to complete; 4) Flows at lift station have returned to normal; 5) Water survey being done by Jeff Dale and found 1 leaking hydrant.

Public Works
John Haberman reported the following; 1) Concrete work and mud jacking is complete at the Liquor Store; 2) Mudjacking is done at the Community Center, with the corner still needing to be ground down; 3) Neinkerk Construction will be working on 9th Street storm drain; 4) Shawn Colbert has been working on grader repairs and has expressed interest in the surplus generator.
Council Member FitzHenry moved, seconded by Council Member Rasche, to approve the sale of the surplus generator to Shawn Colbert for $500. Vote on motion: FitzHenry, Freking, Kuhnau, Rasche, and Wagner, aye; no nays. Motion carried.

Police Department
Chief Fauglid presented his monthly reports to the Council. There were 60 incidents in July, notices have been sent/posted for junk properties. Chief Fauglid reported that he will be doing a public nuisance sweep this fall.

Fire Department
Chief Diemer reported that the hose tester came in, rescue equipment is being looked into, and the Open House is scheduled for September 8, 2018.

Industrial Water Agreements
Council Member FitzHenry reported that he and Mayor Freking met with Shannon Sweeny to discuss upcoming negotiations, 2 different options will be drafted for Council review and approve. 

Other Business
Council received a reminder for the filing period for two Council seats and Mayor is from 7/31/2018-8/14/2018, and that the Primary Election is August 14, 2018.

Claims
Council Member FitzHenry moved, seconded by Council Member Rasche, to approve claims as presented totaling $315,972.88. Vote on the motion: FitzHenry, Freking, Kuhnau, and Rasche, aye; no nays; Wagner, absent. Motion carried.

Mayor Freking moved, seconded by Council Member FitzHenry, to adjourn at 9:06 PM. Vote on the motion: FitzHenry, Freking, Kuhnau, and Rasche, aye; no nays; Wagner, absent. Motion carried.
