HERON LAKE CITY COUNCIL
WEDNESDAY, MAY 1, 2019, 7:00 PM
REGULAR MEETING

The meeting was called to order at 7:00 PM by Mayor Jason Freking, with the following council members present; Glenn Kuhnau, Andrew Rasche, Danni Swanson and Carol Wagner. Others in attendance were Jerry Wagner, Wayne Rasche, Joe Liepold, Police Chief Anthony Fauglid, John Haberman, Tamara Shelton and Stacy J. Grube.

Approval of Agenda
Mayor Freking moved, seconded by Council Member Kuhnau, to approve the agenda with the additions of Zoning Permits, SMBS, RLF updates, and Industrial Water Agreements. Vote on the motion: Freking, Kuhnau, Rasche, Swanson and Wagner, aye; no nays. Motion carried.

Approval of Minutes
Council Member Kuhnau moved, seconded by Council Member Rasche, to approve the minutes of the Council Meeting of April 10, 2019, as presented. Vote on the motion: Freking, Kuhnau, Rasche, Swanson and Wagner, aye; no nays. Motion carried.

City Owned Lots
Melissa Raverty talked to Council about purchasing 302 12th Street and 312 12th Street which are currently owned by the City. It is their intention to build a garage this summer and a home with attached garage being built hopefully next summer. Discussion resulted in:
Council Member Rasche moved, seconded by Council Member Wagner, to approve the sale of 302 12th Street and 312 12th Street for $1.00 each contingent on a house must be built within 3 years or the price of each lot $500. Vote on the motion: Freking, Kuhnau, Rasche, Swanson and Wagner, aye; no nays. Motion carried.

Zoning Permits
Council Member Kuhnau moved, seconded by Mayor Jason Freking to approve the zoning permit of Chad & Melissa Raverty to build a detached garage and home with attached garage on 302 – 312 12th Street. Vote on the motion: Freking, Kuhnau, Rasche, Swanson and Wagner, aye; no nays. Motioned carried.
Council Member Kuhnau moved, seconded by Mayor Jason Freking to approve the zoning permit of Lincoln Ferguson to build a deck at 422 13th Street. Vote on the motion: Freking, Kuhnau, Rasche, Swanson and Wagner, aye; no nays. Motioned carried.

Park Restroom
Council reviewed bids from Bob’s Biffys, Hohenstein Septic and Nienkerk Companies for a handicap accessible restroom facility for the City Park.
Council Member Rasche moved, seconded by council Member Kuhnau to accept the low bid from Hohenstein Septic for rental and servicing for $175.00 per month. Vote on the motion: Freking, Kuhnau, Rasche, Swanson and Wagner, aye; no nays. Motion carried.

League of MN Cities Insurance
Mayor Freking moved, seconded by Council Member Rasche, to approve signing the form indicating that the City of Heron Lake does not waive monetary limits on municipal tort liability. Vote on the motion: Freking, Kuhnau, Rasche, Swanson and Wagner, aye; no nays. Motion carried.

PeopleService
Joe Liepold reported that flushing was done from May 6- May 10, a curb stop was recently repaired, and that he would like to get an estimate from Empire to pump the lift stations.

Public Works
John Haberman reported the following: 1) Tree at Falcon Heights has significant rotting, and has requested that it be checked by someone from the Tree Committee; 2) Chapman storm sewer is full, he will be talking with MnDOT to possibly coordinate using a camera on this line; 3) 5 slabs of sidewalk has been knocked out by RR Crossing on 10th Street, Council directed staff to contact Jackson County.

Police Department
Chief Fauglid reviewed his monthly report, stating that April yielded 70 calls, that he is working with 13-14 properties for public nuisance issues and two part-time officers are now being trained. Chief Fauglid stated that he will be posting MnDOT updates on the PD Facebook page and conducting enhanced patrols on Highway 60.

Industrial Wells
Council held discussion regarding the Industrial Water Distribution Agreements with MnSP and HLBE. Further discussion regarding length of contract and a percentage split based on water usage resulted in:
Council Member Rasche moved, seconded by Council Member Kuhnau, to approve contract decisions as follows; percentage split will be based on previous two years of usage and length of contract will be 10 years. Vote on the motion: Freking, Kuhnau, Rasche, Swanson and Wagner, aye; no nays. Motion carried.

Other Business – No action taken
Ordinance, Good Neighbor Issues – Mayor Freking discussed drainage issues that can arise between neighbors from snow removal and stated that our current ordinance looks out for homeowners but not necessarily business owners. Mayor Freking encouraged Zoning to look out for these potential issues in the future.
Wellfield Water – Joe Liepold stated that he’s been approached about purchasing water from City wells, the amount of water needed would depend on weather. Council was asked if there was a price that would be acceptable. Council tabled the discussion at this time requesting that all other options be explored first.
Southwest Minnesota Broadband – Council Member Kuhnau reported that new equipment is being installed for Zayo and that SMBS is interested in paying off current loans with the City. No concerns with early payout were noted.
RLF Updates – Council was informed that the RLF Advisory Board had met to review status of loans and met with a business owner regarding bringing their loan current.

Claims
Council Member Kuhnau moved, seconded by Council Member Wagner, to approve payment of claims as presented, totaling $78,837.02. Vote on the motion: Freking, Kuhnau, Rasche, Swanson and Wagner, aye; no nays. Motion carried.
